EQUESTRIAN CENTER AGREEMENT
All Equestrian Center Members are provided a copy of the Rules, Regulations, Code of Conduct and Application Agreement that all Equestrian Center Members and their guests must abide by during the term of your stay at the Equestrian Center. Subsequent changes are only enforceable if they are provided in written form by first-class mail to each member.
The failure to abide by the terms of this document (or subsequent changes) may be cause for termination of your privileges at the Equestrian Center per the Equestrian Center Revoked Privileges Policy.
All use of the Equestrian Center and trails is on a “use at your own risk” basis.
All fees and/or deposits are listed in the HROA SCHEDULE OF FEES
All fines and/or other penalties are listed in the HROA SCHEDULE OF MONETARY PENALTIES
EQUESTRIAN CENTER
RULES, REGULATIONS & CODE OF CONDUCT
1. HROA shall provide paddock space for the accepted animal with groundskeeper (wrangler) and feeding services and access to water. Owner is responsible for maintenance of their space and provision of feed for their animals. All portions of feed will be the responsibility of the owner including the bagging of cubes.
2. Property Owners and/or tenants in good standing are eligible for stabling horses. Property Owners must remain in good standing at all times as specified in HROA’s good standing policies for assessments and fines, and the Equestrian Center Revoked Privileges Policy.
3. Any equestrian account that is delinquent will have the equestrian privileges revoked until the account is brought current per the Equestrian Center Revoked Privileges Policy.
4. Without exception, any new Property Owner or tenant who stables a horse in the Equestrian Center must adhere to the following – Before a Property Owner or tenant is allowed to stable a horse, they must complete and sign the Application Agreement, pay all fees due, provide proper proof of insurance, provide a current picture of the horse to be stabled and a copy of current shot records, and pay a deposit per horse to secure against any unpaid equestrian area obligations made payable to HROA. Each horse is required to have its own separate Application Agreement. All of these requirements must be completed and submitted to the HROA Office which needs a 7 day minimum processing period before any horse or paddock can be brought into the Equestrian Center. Tenants must additionally have written permission from the Property Owner, that they are aware the tenant has a horse.
5. Before the refund of the deposit will be returned, after the removal of the horse and all personal belongings, the Equestrian Committee will inspect the premises to assure proper clean-up has been completed. Failure to comply within 30-days will result in an automatic forfeiture of the deposit unless other arrangements have been made to the satisfaction of the Equestrian Committee. (Any time and material costs incurred by HROA to clean up the area will be charged to the Property Owner responsible for the site.) All property left behind after 30 days upon removal of any horse becomes the property of HROA.
6. The Equestrian Center Rules, Regulations and Code of Conduct must be followed by all. Anyone failing to comply with these rules is subject to being cited by HROA Security and / or Code Enforcement, with possible elimination from the Equestrian Center per the Equestrian Center Revoked Privileges Policy. The Groundskeepers may provide a member a correction notice (red tag) to attempt to obtain voluntary compliance of any rule infraction or notify HROA Security and Code Enforcement of rule violations. The Groundskeepers, Equestrian Committee, or any member, may utilize a witness statement form or Membership Communication form provided by HROA Security or HROA Office personnel and call Security if necessary.
7. All horses are required to have all necessary shots, a worming program, and provide yearly updated records with receipts and dates to the HROA Office by the end of each calendar year. At the beginning of the new year an annual notice will be sent and citations given if not current. Members must make sure that their guests are aware of these rules. Guests have a two day maximum stay without prior approval from the Equestrian Committee. An overnight fee per night applies.
8. The Equestrian Center shall have no more horses than are specified in the Equestrian Center Master Plan adopted by the HROA Board of Directors. There shall be no more than four paddock spaces (four horses) allowed per member. Currently, there are 85 total available spaces. Some spaces may be eliminated to allow for buffer areas. The HROA Office maintains a waiting list when the Equestrian Center is full. When there is a waiting list, two paddock spaces will be the maximum allowed to be reserved by a member.
9. The monthly fee per paddock is due on the first of each month. If the monthly fee is not paid by the fifteenth, a late fee will be assessed. Once the space is first paid for, the paddock needs to be up within 30 days according to the standards set forth in these rules or unless additional time is approved by the Equestrian Committee.
10. Property Owners and/or tenants are totally responsible and take full liability for, under their own personal insurance, their guests, any horses that are at the Equestrian Center or on HROA property, and their behavior. This includes clean-up around where their guests park their horse trailers, clean-up of stalls used or any other area where they were present. If a Property Owner or tenant does not comply they are subject to being cited. Any person who causes damage to HROA’s property or other property in the Equestrian Center will be held responsible through the responsible Property Owner.
11. There is a 5 MPH SPEED LIMIT in the Equestrian Center!! Violation of the speed limit is subject to a citation. Repeated violations will subject the violator to loss of driving privileges within the Equestrian Center per the Equestrian Center Revoked Privileges Policy.
12. No domestic pets (other than dogs) are allowed in the Equestrian Center. Dogs, however, must be on a leash. Owners of uncontrolled dogs are subject to receiving a citation, per the HROA rules and / or be banned from the Equestrian Center altogether. Equestrian Center dog owners may have their dogs with them on horseback, as long as they are well trained on voice command.
13. When riding, dismount to smoke. Remain dismounted until finished and no sign of flame or smoke exists. No firework displays allowed. No glass containers of any kind are allowed in the Equestrian Center. Please be sure to turn out the lights when finished in the barn, stalls and center. No smoking in the barn.
14. NO mistreatment or negligence of animals will be tolerated. Stabling and boarding privileges of horse owners whose animals are not properly fed or cared for, such as having no food or water for your horse is cause for revocation of your privileges per the Equestrian Center Revoked Privileges Policy. You are responsible to know if you are out of hay, and will receive a courtesy call reminder when out. Continual calls or abuse is subject to a citation(s) being issued or revocation of your privileges.
15. Motorized cycles are prohibited.
16. No children under twelve (12) years of age of any Equestrian Center Member will be allowed in the Equestrian Center without parental supervision. Unruly children of Equestrian Center Members are subject to additional age restrictions, to be determined by the HROA Board of Directors on a case by case basis at the recommendation of the Equestrian Committee. Non-Equestrian Center Members’ children are NOT allowed in the Equestrian Center without parental supervision. Parents take full responsibility for their children’s behavior, whether they are present or not, regardless of the child’s age.
17. Permission for special equestrian events must be obtained from the General Manager and the Equestrian Center Committee prior to the events being scheduled. Special rules will be established for these events as needed.
18. Horses may be ridden in the Equestrian Center and on designated equestrian trails using proper trail etiquette. Please use courtesy.
19. All horses must be walked in the Equestrian Center (from the barn to the south end of the paddocks). No horses are allowed around the Recreation Barn or the maintenance area. The lawn area around the Recreation Barn is off limits. No horses are to graze there or to be on the lawn area in any manner. This is a common area and you are subject to being cited by HROA Security.
20. No horses are to roam loose except in their paddocks and designated areas. Horses must be haltered and led by hand at all times in all other common areas. Do not leave your horse unsupervised in common areas.
21. No horses are allowed at the marina or the campground areas or in any park.
22. Wooden box stalls, pasture time and hay storage in the barn area are on a first come, first serve basis. Wooden box stalls are not to be monopolized or used permanently without special permission. There may be a waiting list which is maintained at the HROA Office.
23. Water will be provided in the area of the paddocks. Feed shall be the responsibility of the individual horse owner. You are responsible for purchasing your own hay and checking your own water levels and keeping the water clean and free of mosquitoes.
24. You are expected to store your own hay in your shed (space assigned to you from the Equestrian Center Master Plan) or in an assigned space in the upper hay barn area (See #22). All sheds, shelters and belongings must be secured. Please clean-up after yourself. NO SMOKING permitted and NO flammable liquids are to be stored in the upper hay barn area.
25. Horse owners must keep paddocks, sheds and adjacent areas neat, clean and sanitary which includes manure pick up and raking of urine. Your paddock is subject to daily inspection. If any repairs are necessary, you must do them. All paddock equipment must be maintained according to Equestrian Center guidelines with a clean overall appearance and no safety hazards. (See Paddocks, Sheds & Shelters) If paddock and area are not kept clean, orderly and safe, the paddock owner is subject to being cited. Continued neglect is subject to further enforcement (See #14). Emergency measures may be taken by an HROA representative to attempt to mitigate a dangerous situation.
26. Show respect for your fellow Equestrian Center Members and their belongings. You are not allowed to verbally abuse anyone while in the Equestrian Center. Do not go in to a paddock or shed without permission. Do not touch their horse, paddock, or belongings without permission.
27. If you are going to do something that may frighten the other horses (i.e.: moving or putting up pens, shelters or sheds, or bringing sand in), please notify the horse owners in your area. Phone numbers are posted on the bulletin board at either end of the Equestrian Center. Please keep your phone numbers current through the HROA Office.
28. Soiled bedding and manure must be placed in specific areas, located at each end and in the middle of the Equestrian Center. No trash of any kind is to go into manure areas. There are trash cans available for all non-manure items. Old hay may be deposited next to the manure pits. You are responsible for cleaning up after your horse EVERYWHERE except the large arena. Use free green waste containers and free recycle containers at the upper manure pit area for your trash. All other trash is to go into the dumpster paid for by Equestrian Center Members. Use appropriate cans available in several locations in the Equestrian Center or take your trash to the upper containers provided. If all cans are full, take your trash home.
29. No stallions over one year of age are allowed in the Equestrian Center. Colts must be gelded by the age of one year.
30. Horse trailers may only be parked / stored in areas designated by HROA. There will be horse trailer storage available in two locations. One is behind the upper hay barn (spaces 1-18) and another one is in the parking lot by the main entrance to the Equestrian Center between the driveway and fire hydrant (spaces 19-30). These storage spaces will be assigned for Equestrian Center Members only and must be assigned a spot through the HROA Office. No other storage of any other types of vehicles or trailers will be allowed in these areas. One horse trailer is allowed per member, not per paddock space. If parking spaces are full, a waiting list will be maintained at the HROA Office. Guest horse trailer parking will be by the Maintenance area in old paddock space 1 and space 2. Larger trailers will be assigned separately. Additional temporary day use parking for horse trailers is allowed in the new Equestrian area along the fencing facing Equestrian Road. This is available for Equestrian Center Members and their guests for day use only.
31. You are not allowed to verbally abuse the Groundskeepers or hinder him / her in the performance of their duties. If there is a problem, contact the Equestrian Committee through their meetings or the Maintenance Supervisor, or fill out a complaint form at the HROA Office. Groundskeepers are NOT allowed to give advice on any subject except pertaining to feeding arrangements for your horse. (See Groundskeeper Job Description)
32. Keep all horses, vehicles and people clear of the hay truck while the Groundskeeper is feeding.
33. When Equestrian Center Members have appointments with their farriers or vets, please be courteous and wait until their appointment is over to ask questions. They are paying them for their time; you may have time with them later. Please have them use your area (when possible) and not use our common areas. Do not tie up the wash racks all day for your farriers. There will be a shoeing station specifically for farriers, please use this one when possible. The farriers are not to park as to block any driveway. Clean up after your farrier at all areas. The horse owner is responsible for the farrier while in the Equestrian Center and is subject to being cited if necessary.
34. Groundskeepers will feed twice a day, seven days a week unless otherwise notified (some holidays may be given time off).
35. In all cases, through traffic must be maintained in all roadways within the Equestrian Center. No parking is allowed which will block any gate or drive through, or use of the facilities. The parking lot is to be used for general parking when possible. Parking of vehicles near your shed is for temporary loading and unloading only. Blocking traffic is subject to a citation being issued.
36. Any person whom is deemed to be a nuisance or threat to the community (i.e. habitual non-compliance of rules or disregard for others safety, etc.) is subject to being denied use of the Equestrian Center as stated in the Equestrian Center Revoked Privileges Policy.
37. Excessive watering of the roadways and paddock areas is prohibited. Light watering of roadways and paddock areas for dust control is acceptable.
38. Use of the wash racks is strictly for the Equestrian Center Members and their guests, and guest horses that pay the nightly guest rate fee. If a Ranch Resident with horses not boarded at the Equestrian Center wishes to use the wash racks, they are subject to being charged the overnight stay for a guest horse fee. (The Equestrian Center Members pay for the water out of their monthly rental fee.) Personal use of water from the Equestrian Center is prohibited (i.e. filling storage tanks and hauling the water elsewhere) and may result in a citation being issued.
39. Questions may be submitted to the Equestrian Committee in writing, or by attending one of the scheduled meetings. Do not approach Equestrian Committee members with complaints while at the Equestrian Center while the Equestrian Committee member is taking care of or riding their horse(s). If you have a complaint, you need to submit your complaint in writing to the HROA Office.
40. It is the responsibility of all Equestrian Center Members and their guests to read the bulletin boards at the Equestrian Center to receive updated communications, and memos posted on the two bulletin boards located at the upper and lower entrances in the Equestrian Center. The bulletin boards are for official business only, and are not to be used for posting personal messages. (All postings will be available through the HROA Office or by e-mail either through the HROA Office or Equestrian Committee.)
ROUND PENS & HOT WALKER
The round pens and hot walker are available ONLY for all Equestrian Center Members and their guests who are expected to abide by these rules. All other Property Owners with horses, along with their tenants and guests are NOT allowed to use these facilities. Equestrian Center Members who want to work their horses have priority over others using the round pens.
1. Make sure to clean up any manure that your horse leaves in the round pens or hot walker.
2. Latch the gate(s) when you are done.
3. Do not tie your horse to the round pens. Horses have pulled down the panels in the past.
4. No playing on panels, no jumping over fences, no throwing of objects. These activities may cause other horses in adjacent arenas to become restless or excited. NO EXCEPTIONS!
5. Do not leave your horse unattended on the hot walker.
6. All guests of Equestrian Center Members using the large arena must be supervised by an Equestrian Center Member.
7. You must be at least 18 to use the hot walker.
8. Do not ride your horse while it is in the hot walker enclosure.
9. No loose horses allowed in hot walker enclosure, they should be tied at all times.
10. At no time are dogs allowed in the round pens or near the hot walker.
PASTURE & TURN-OUT
The pasture and turn-out are available for all Equestrian Center Members use ONLY, subject to a waiting list.
1. Pasture is on a first come first serve basis, using it at your own risk.
2. Days are split into two time slots. The “morning” time slot is from 9:00 a.m. to 1:00 p.m. (having the horses out before 1:00 p.m.). The “afternoon” time slot is from 1:00 p.m. to 5:00 p.m. (having the horses out before 5:00 p.m.). NO HORSES ARE ALLOWED IN THE PASTURE OVERNIGHT. After the “afternoon” time slot (5:00 p.m.), the pasture is available for first come first serve use until dark, or 9:00 p.m., which ever comes first.
3. Time slots are one per Equestrian Center Member, preferably with more than one horse and with Equestrian Center Members sharing the same time slot, making more time slots available for others to use. Names, times and phone numbers will be posted on the bulletin boards of those who have designated time slots. If you do not use your time slot, others can call you and ask to use it. Also posted on the bulletin boards are names and phone numbers of Equestrian Center Members who do not have designated time slots but request to be called to use someone’s time slot if it is not going to be used. When there is a waiting list for pasture and you repeatedly neglect to use your designated time slot or fail to contact others waiting to use it, you are subject to loosing your time slot, which will be determined by the Equestrian Committee. Please check the bulletin boards and be willing to offer to share when possible.
4. If you are going to be late, please call the person after your time, or if you are not going to use your time, be willing to call someone who may wish to use your time slot.
5. There is to be no feeding of the horses in pasture.
6. The turn-out is to be used for turning your horse out only. No riding, no feeding and no dogs allowed. There is a one hour turn out limit. If you have used it already in the same day, and another Equestrian Center Member who hasn’t wants to, please remove your horse so others can have the opportunity.
LARGE ARENA, WOODEN BOX STALLS & WASH RACKS
The large arena is available for all Property Owners with horses, along with their tenants and guests, who are expected to abide be these rules. Any person other than an Equestrian Center Member or that Equestrian Center Member’s guest using the large arena is expected to be registered through the HROA Office, which registration may be kept on file yearly (except for guests). Use of the large arena by any non-Equestrian Center Member’s guest must be submitted prior to the planned use and may be only for up to one week at a time. All Equestrian Center Members have first priority for using the large arena.
Any non-Equestrian Center Member using a wooden box stall or wash racks for any reason is expected to be registered through the HROA Office and pay a fee. Application for rental of the wooden box stalls must be submitted through the HROA Office prior to the planned use.
Please remember that the HROA Office is not open on weekends, so that all paperwork must be completed and approved by the HROA Office prior to the weekend for weekend use.
1. All riding in the large arena is at your own risk.
2. There is no exclusive use of the large arena without permission from the Equestrian Committee. Riders have priority at all times with a 30 minute limit for use of obstacles. Obstacles are available only for Equestrian Center Members and their guests use.
3. Latch the gate(s) to the large arena and keep closed at all times.
4. Do not leave your horse unattended in the large arena. There is a 20 minute turnout limit. Please remove your LOOSE horse in the large arena if a rider wants to ride. If you are NOT available to get your horse out, you are subject to being cited.
5. No playing on panels in the large arena, no jumping over fences, no throwing of objects. No activity in the large arena will be allowed that frightens other horses and riders. NO EXCEPTIONS!
6. All guests of Equestrian Center Members using the large arena must be supervised by an Equestrian Center Member.
7. There is no riding allowed in the large arena while it is being worked.
8. There is no use of the large arena when it is flooded.
9. At no time are dogs allowed in the large arena or wooden box stalls.
10. Property Owners and tenants who wish to use the large arena, or allow their guests to use the large arena, must be in good standing and be registered at the HROA Office. The Property Owner or tenant is responsible to provide proof of INSURANCE for all horses they are responsible for before they may enter the Equestrian Center, along with records showing their horse(s) is current on vaccinations.
11. Property Owners and tenants other than Equestrian Center Members and ALL guests who wish to use a wooden box stall must be registered at the HROA Office. The Property Owner or tenant is responsible to provide proof of INSURANCE for all horses they are responsible for before the Property Owner, tenant or guest may enter the Equestrian Center, along with records showing the horse(s) is current on vaccinations, and pay the appropriate overnight fee. This information must be submitted with the application which must be filled out and signed by the Property Owner or tenant. Persons paying to use this facility take priority over Equestrian Center Members’ free use (unless the horse is ill, pregnant or injured).
12. Any wooden box stall occupied MUST have the processed application attached to the clip next to the stall door prior to occupancy of the stall, or if used by an Equestrian Center Member, it must have the name of the Equestrian Center Member along with the name of the horse.
13. If a horse using a wooden box stall becomes ill or is injured, the Groundskeeper or any Equestrian Committee Member who is aware of the illness or injury will attempt to notify the responsible Property Owner or horse owner. If unsuccessful, and an emergency exists, the Equestrian Committee may engage the services of a veterinarian of their choice, call the SLO County Sheriff or provide any other attention that appears advisable. The Property Owner is responsible for payment of these services within 30 days from notification of the amount.
14. HROA and the Equestrian Committee reserve the right to refuse stay for day or overnight, of any horse that may be sick or dangerous or subject to causing damage to HROA property. No stallions are allowed at the Equestrian Center at any time.
PADDOCKS, SHEDS & SHELTERS
1. Paddocks are to be set up in conformity with HROA and the Equestrian Center, at the owner’s expense. The required size for each paddock is 24’ x 48’ and must be made from heavy gauge, 4 rail round galvanized pipe panels, no shorter than 12’ only. No portable panels.
2. Each 24’ x 48’ paddock shall accommodate no more than one horse. (Exception: Mare with foal under 9 months of age). After that age, the owner must put the foal in its own paddock with all requirements fulfilled. Two miniature horses are also an exception. As long as the two miniature horses are owned by the same person, they may share a paddock space and pay an additional fee. There shall not be a full-sized horse sharing the same 24’ x 48’ paddock space with a miniature horse, unless two full sized paddock spaces are rented.
3. Each paddock must have a sign identifying the name of horse, the name of the owner, the paddock number, your preferred veterinarian and their phone number, and the owner’s phone number.
4. Subleasing any paddock is prohibited. Any horse in any other person’s paddock MUST have written consent of the paddock owner on file with the Equestrian Committee at all times. If not, the horse MUST be removed from the paddock immediately. Even with consent, there is a two week maximum stay unless prior approval is obtained from the Equestrian Committee. Anyone in violation is subject to a citation and will be charged the per night guest rate fee if the horse belongs to a non-Equestrian Center Member. There shall be NO non-Equestrian Center Member’s horse kept at ANY time in the paddocks. This is what the wooden box stalls are for. The Equestrian Center does NOT want to take responsibility for unknown horses mixed in with our stabled horses.
5. The paddock must include an acceptable manufactured metal (8’ x 12’) shelter. No wooden structures will be allowed inside the paddock. Any structure MUST be approved by the Equestrian Committee. All shelters must be portable but secured for winter. No cement may be used. Make sure you can take it with you when you vacate.
6. The paddock also needs a water trough and feeder.
7. Each paddock space is assigned one shed space. Size, color, material and location of each shed is to be determined by the Equestrian Committee and the Master Plan located at the entrance of the Equestrian Center. Any shed placed in the Equestrian Center must have prior written approval from the Equestrian Committee (See MAKING IMPROVEMENTS OR CHANGES ON EQUESTRIAN CENTER PROPERTY). Wooden structures are allowed in the Equestrian Center subject to uniformity and damage that may be caused by horses. In no case may any structure exceed 12’ in height or 140 overall square feet; and must fit in the area designated. Any sheds on someone else’s assigned spot must be removed within 30 days. (A color palette is to be established by the Equestrian Committee.)
8. There is to be no hazardous equipment in or around the paddock areas. Each paddock and shed area is to be kept clean and orderly. The Equestrian Committee may occasionally do a walk through of the Equestrian Center and request that certain items are corrected. If not complied with, a citation may be issued.
9. No overnight parking of any vehicle or trailer is allowed in the Equestrian Center without prior permission/approval.
10. If you are creating an enclosure in your paddock, it needs to be tan metal. No plastic or wood is allowed. Galvanized metal is permissible, if painted tan.
11. A small storage container, such as a Rubbermaid-style storage chest/cabinet, may be placed near your paddock/shed space with approval of the Equestrian Committee. Such unit must be latched and kept in good condition.
12. PERSONAL TREE MAINTENANCE POLICY: After getting permission from the Equestrian Committee to plant trees in your area, you must maintain them yourself. If you have moved into a space that has a tree already there, it is the new Equestrian Center Member’s responsibility to maintain that tree as if they planted it. Maintenance includes: keeping the trees safely trimmed out of the way of travel for vehicles and roadways; and trimming them high enough so horses cannot eat them, or trimmed to keep off neighbor’s paddock and shed. If a tree becomes a hazard, and damages yours or other’s property, you are responsible. You are responsible for all damage done and repairs necessary. If a tree is dead, you are responsible to take it out. If you cannot do this, you will have to pay HROA to do it for you.
MAKING IMPROVEMENTS OR CHANGES
ON EQUESTRIAN CENTER PROPERTY
In order to create and maintain records and obtain approval for projects within the Equestrian Center, it will be necessary to apply with the Equestrian Committee through the HROA Office for any project affecting the Equestrian Center. An application form must be filled out and a plot plan must be provided. The goal of this procedure is to have all Equestrian Center Members apply for proposed project approval similar to the way Property Owners presently apply to the HROA Architectural & Environmental Control Committee for improvements to their private property. There is no charge for applying and obtaining approval. No improvements are to be initiated without approval. Please allow for 7 days processing. ALL improvements will require a final inspection and sign-off by the Equestrian Committee.
WHAT I NEED APPROVAL FOR
Generally, any improvement or change to Equestrian Center property, and the proposed location thereof is subject to the approval of the Equestrian Committee. The type of projects that need approval by the Equestrian Committee include, but aren’t limited to:
● Any and all installations of -- Storage Buildings (Sheds), Paddocks (Stalls), Storage Containers, Landscaping (planting of trees, etc.)
● Any and all alterations including such things as – re-paints, re-roofs, replacements or repairs
● Any and all relocations
● Any and all demolitions
EQUESTRIAN CENTER
APPLICATION AGREEMENT
1. HROA shall provide paddock space for the accepted animal, limited feeding and groundskeeper service and water accessibility. Owner is responsible for their space and provision of feed for their animals.
2. Owner agrees to pay for these services at the monthly rate established by the HROA Board of Directors. A $10.00 late fee will be assessed if the account is unpaid by the 15th of the month. Any part of a calendar month will be considered a full calendar month for the purpose of determining the proper charges.
3. Owner represents that they are the owner of the animal. Owner certifies that all the information stated regarding the animal is correct. Owner guarantees that the animal is in good health and has not been exposed to any contagious disease within the past 30 days and agrees that immunizations and records will be kept current and reported to the HROA Office.
4. Owner agrees to indemnify and hold HROA harmless from all liability for any loss, damage or injury to persons, animals or property arising from or related to the services provided to the animal. Owner agrees that HROA shall not be liable for loss of or damage to the animal by any cause whatsoever, including but not limited to fire, theft, or escape of the animal. If a horse becomes ill or is injured, the Groundskeeper or any Equestrian Committee Member who is aware of the illness or injury will attempt to notify the Equestrian Center Member who owns the horse. If unsuccessful, and an emergency exists, the Equestrian Committee may engage the services of a veterinarian of their choice, or provide any other attention that appears advisable, including calling the SLO County Sheriff. The Property Owner is responsible for payment of these services within 30 days from notification of the amount.
5. Owner further agrees to provide evidence of a minimum of $300,000 personal liability insurance as part of the application process.
6. Owner hereby grants a lien on the animal to HROA for all unpaid charges due HROA. If any such changes are not paid within 45 days of billing, HROA may, on five (5) days written notice to the owner specifying the amount due and informing the owner that payment within fifteen (15) days will entitle owner to redeem the animal, sell the animal at public or private sale to satisfy the account. The notice may be served by registered or certified mail with return receipt requested, sent to the owner’s address. The proceeds of the sale, after paying the expenses of the sale, shall be applied to liquidate the debt, including all charges accrued in caring for the animal up to the date of the sale. The balance, if any, shall be paid to the owner. If the proceeds of the sale are insufficient to pay the expenses of the sale and satisfy the account, the owner shall pay the balance to HROA. This provision does not in any way limit HROA’s legal remedies against the owner.
7. If any legal action is brought to enforce the provisions of the agreement, the prevailing party shall be entitled to recover reasonable attorney’s fees. These fees, which may be set by the Court in the same action or in a separate action brought for that purpose, are in addition to any other relief to which the prevailing party may be entitled. This provision applies to the entire agreement.
8. Any dangerous animal, as determined by the Equestrian Committee, is subject to being removed from the premises per the Equestrian Center Revoked Privileges Policy. Stallions must be gelded by one year of age.
9. If there are questions, they should be submitted in writing to the HROA Office or the Equestrian Committee.
