1 - One (1) complaint regarding a camper who could not sleep due to the number of trucks racing up and down the roadways late into the evening, yelling, screaming, etc.

Action: A report was made to Security the morning after the incident, with no additional action taken due to the time delay.    

2 - One (1) complaint regarding the bus stop lights at Gateway Park being too small.   

Action: HROA inspected the site and found the lights were visible in unfavorable conditions to at least 50 yards.  HROA is monitoring the situation as the lights were changed out related to the solar battery charge available at the site.

3 - One (1) complaint regarding a member storing wood in front of their house for sale.  

Action: Investigating Officer issued a citation. 

4 - One (1) complaint regarding a member storing items in the greenbelt in Tract 1990

Action: Investigating Officer contacted member.  Items move to within the private property lot.

5 - One (1) complaint involving a neighbor leaving trash cans out, and illegally parking their motorhome

Action: Investigating Officer issued a citation. 

6, 7 - Two (2) complaints regarding branches of a tree located on a private lot needing to be trimmed related to clearance on the roadway.

Action:  Investigating Officer issued a “Notice to Comply” to the owner.  Also turned over to Maintenance.     

8 - One (1) complaint involving underage activity in the neighborhood at all hours of the night, and riding of dirt bikes on the roadways

Action: Turned over to Security who is working on the matter, and related issues.           

9 - One (1) complaint related to the winds/storm in October, causing an oak tree in the common area to fall on the owner’s shed in their back yard.

Action: HROA Office turned over to Insurance Company.           

10 - One (1) complaint involving drug dealing and loud partying.

Action: Turned over to Security who is working on the matter.               

11 - One (1) complaint involving erosion from a neighboring private lot into the roadway.

Action: Turned over to Security who inspected the site and notified the lot owner to shore up the erosion control.           

12 - One (1) complaint regarding the tennis courts at Equestrian Park needing maintenance.

Action:  Maintenance Manager is obtaining bids.           

13 - One (1) complaint involving a neighbor having three (3) dogs which are kept in cages, barking all the time, along with dog feces not being cleaned up.

Action: Turned over to Security who issued a “Notice to Comply” after interviewing several of the neighbors.           

14 - One (1) complaint involving a neighbor leaving their vehicle stored in the roadway.

Action: Turned over to Security to monitor.

Summary of action taken at Board Meeting(s) for October 2009

In October 2009, the Board of Directors held the 2009/2010 First-Quarter Board Meeting on October 16th.  The following appeals / security related issues were discussed or acted on (by agenda item):

 

 SEQ CHAPTER \h \r 12.  Property Owner Appeal – Scholl, Citation #9566, $775.00, Defacing Common Area, Unlicensed Driver, Unsafe Driving

Request this citation be reduced to $200.00 + $75.00 damage, removing “Defacing Common Area” of $500.00 due to issue being an accident.  Action: Approved to reduce to $200.00 + $75.00 damage

 

3.  Property Owner Appeal – Norris, Citation #9403, $100.00, Parking on Launch Ramp (4:30 p.m.) Action: Upheld

 

4.  Property Owner Appeal – Hajduk, Citation #9482, $50.00, Dog Impound (4:45 p.m.) Action: Reduced to a Warning

 

5.  Property Owner Appeal – Allen, Citation #9343, $325.00, Failure to Stop & Foul Language (5:00 p.m.) Action: Waived the $50.00 Failure to Stop and Upheld the $25.00 Failure to Stop for Security Officer, and $250.00 for abuse of employee

 

6.  Property Owner Appeal – Mitchell, Citation #9296, $500.00, Illegal Dumping (5:15 p.m.) Action: Reduced to a Warning

 

7.  Property Owner Appeal – Perez (resident of tenant Lauer), Citation #9322, $300.00, Public Indecent Exposure (5:30 p.m.)

8.  Property Owner – Lee, Citations (various), $750.00.  Requesting leniency for Tenants citations (5:45 p.m.) Action:

Upheld

 

Also approved was the new 5-Year Boat Slip Lease to begin January 1, 2010, which included a Boat Slip Management Policy, a revised Boat Slip Response Policy, and a “guest” fee(s) of $10.00 / day for “guests”, and $10.00 / week for use by other members acting as the Lessee’s “guests”.

 

 SEQ CHAPTER \h \r 1The Board discussed a proposed sloping lot line adjustment (variance) for Lot 11 of Tract 424, owned by Jezek which was approved with the understanding the conditions meet SLO County 22.10.140D (2)(b), with the AEC Committee verifying the conditions are met

 

The Board disapproved issuing a postcard to Tract 424 regarding a proposed encroachment in the side setback for an awning/carport for Lot 29, and directed the owner submit plans to the AEC Committee to represent all elements of the project, for the AEC Committee to either approve or disapprove said plans, and that any disapproval by the AEC Committee may then be appealed to the HROA Board. 

 

 SEQ CHAPTER \h \r 1The Board discussed a complaint from Jason Cardena, Lot 60 of Tract 1094/3, related to handling of pool overcrowding – requesting the Board consider potentially providing an allotted time period, instead of a first-come first-serve procedure.  The Board tabled that request indefinitely.

Summary of Security-Related Activities

HROA Security continues to assist law enforcement with forty two (42) law enforcement related incidents, including but not limited to; 15 disturbing the peace, 1 check the welfare, 2 thefts, 5 trespassing, 5 vandalisms, 1 domestic violence, 2 shots fired, 2 traffic accidents and 1 DUI arrest, as well as 6 crimes which required an investigation.  Security also handled an additional 48 dog related incidents.  

 

The investigated crimes included: an aggressive dog(s), 3 vandalisms, a theft, and a traffic accident which included a DUI arrest.    

 

In the 3000 block of Water View Drive two citations were issued.  Animal regulations was contacted in regard to two aggressive dogs.  During the investigation Security Officer McCaghren not only witnessed the aggressive behavior but became victim of an attack.  No injuries were reported.

 

A vandalism occurred in Tract 693, in the 5100 block of Northfork Place; a tire slashing occurred while the victim’s vehicle was parked unattended. The SLO Sheriff’s Department was contacted along with HROA Security.  During the investigation possible suspects were named and the investigation was then turned over to the Sheriff’s Department.  At this time the disposition of the case is unknown.      

 

Two additional vandalisms were investigated; the victim in both cases is HROA.  On Heritage Loop Road an off-roader damaged approximately $500.00 of wire along with ground erosion damage.  No information at this time is available on either the driver or vehicle.  The second vandalism occurred at the North Gatehouse.  The suspect drove through the gate arm and damaged the arm assembly.  The vehicle is described as a white Chevy Pick-Up towing a MasterCraft boat.  Security has photographs of both. If anyone has any information regarding this incident you are urged to call Security Officer Garner at 805-227-6560. Security will make the photographs available for your identification. 

 

A theft occurred in Tract 447 on Happy Hunting Circle.  Unknown suspects removed four “Bearing Buddy Bras” from a parked unattended boat trailer.  The value is $40.00.  The victim noted that the suspects hid the crime by replacing all four wheel covers. This theft is still under investigation. 

A hit-and-run traffic accident and DUI arrest occurred on October 18, 2009.  The hit-and-run occurred on Longhorn Lane.  HROA Security arrived, and the victim did not wish to prosecute due to the minor damage occurring.  HROA Security then received a phone call regarding an erratic driver in a Chevy Avalanche.   This was the same vehicle described in the hit-and-run on Longhorn Lane.  The vehicle was stopped by HROA Security and the driver was taken into custody for DUI and turned over to the California Highway Patrol (CHP).  A citation for DUI was issued by HROA Security.             

 

On October 29, 2009, at the Main Gatehouse, an HROA employee displayed systems of a stroke in progress.  Two HROA employees; Security Officer Garner and Gate Attendant Secrease took immediate action, went beyond the call of duty and assisted the HROA employee until help arrived.  The employee was diagnosed at Twin Cites Hospital to have suffered from a mini stroke.  The employees were commended for their actions.

Tip of the Month – “Tis the Season for” SCAMS

 

This is the season for “SCAMS” with the holidays approaching. In the past few months many scams have impacted SLO County.  Some of those include: 1) A jury scam asking personal information for failing to appear for jury duty; 2) A Medicare scam asking for personal information including a bank account number and location; and 3) A charity scam claiming to represent local law enforcement asking for donations.

 

Many scams are designed to make you a victim of identity theft.  When donating money, make sure you verify the charity first.  Also, NEVER send money to receive a prize, for example winning the Lottery. If you recall, it was recently reported that grandparents in our area received a call from their grandson who was reported to be in jail in Canada, and requesting bail money.   It turned out not to be their grandson who was safe and in SLO County.  No money was exchanged.          

 

Do your homework, and contact local law enforcement if you have any reason to believe you have been contacted by one of these scam artists.  Law Enforcement may not be able to investigate the crime but they can advise you of the legality of the organization.
