One (1) complaint regarding two juveniles harassing a young girl and using foul language at the young girl’s mother.
Action: Citation issued to one of the juvenile’s parents, with Member to be witness at the HROA Violation Hearing.
One (1) complaint from a Member claiming to have received numerous citations with no violations occurring. Requested meeting with the Board of Directors with complaint directed at Security Manager and General Manager.
Action: Board of Directors met with Member, and substantiated need to comply with CC&Rs which were being violated. Two warnings had been issued. One citation which had not been processed through HROA Violation Hearing was voided to give Member time to make arrangements to comply with CC&Rs. Complaining Member advised of Board’s findings.
One (1) complaint regarding a storage trailer left on Gateway Drive.
Action: Turned over to Security to resolve. Trailer was flagged for towing with 7-day notice; it was then removed by its owner.
One (1) complaint regarding a neighbor’s yard being unkempt.
Action: Turned over to Code Enforcement to resolve.
One (1) complaint regarding a neighbor purportedly building a guest house in backyard without AEC approval.
Action: Investigating Officer met with neighbor who had placed a Park Model RV in their backyard, which was determined not to be in violation or requiring of AEC approval; a warning was issued to require screening of the open chain link fencing around the same. Complaining Member advised.
One (1) complaint regarding an unidentified individual purportedly taking pictures of homes in Tract 1063.
Action: Investigating Officer found person to be living in Tract 1910 and interviewed them. The party stated they worked for the Federal Census Bureau and apologized for any confusion.
One (1) complaint regarding a neighbor’s lot being unkempt, with junk strewed about.
Action: Investigating Officer had issued a warning notice prior to receiving complaint with follow-up to be completed within 14 days. Complaining Member advised.

3. Property Owner Appeal – Smith, Citation #8813, $1,500.00 Defacing the Common Area (5:00 p.m.) Action: Citation reduced to $500.00 + $200.00 clean-up for Maintenance to restore area

13. Draft on proposed Board Manual outline, as prepared by attorney Scott Baker Note: focus at this time is on HROA’s complaint procedure. Action: Discussion with attorney present
SEQ CHAPTER \h \r 119. Review and comment on the proposed Accessory Buildings / Outbuildings rule; and modification to the existing rule for 4.01.03 Fences, Walls, Patios, Pools and Decks – Special Provisions On October 17, 2008 the Rules and Regulations Book was adopted absent 4.01.08 Accessory Buildings / Outbuildings, which was being reviewed by the AEC Committee for recommendation. On February 26, 2008 the AEC Committee met and agreed to a proposed final draft. Proposed changes were also suggested to be made to 4.01.03 and 4.02.02. The AEC Committee met on March 12, 2009 to review the final draft prepared by GM Richey in preparation for the March 13, 2009 Board Meeting. At the March 13, 2009 Board Meeting, it was approved to mail out a copy of the proposed rules to all members and solicit comments over the course of the next two meetings (April and May of 2009). On April 1, 2009 a copy of the proposed rules was mailed to all members. General Discussion. GM Richey to post all written comments received on the HROA website

29. Moore, Lot 66 / Tract 1990 AEC fence approval of April 9, 2009 The approval of April 9, 2009 was suspended by the General Manager on an emergency basis, due to issues related to that approval not conforming to the Board-adopted resolution and County conditions for this tract. Action: Upheld suspension (thereby disapproving project)

Summary of Security-Related Activities
HROA Security continues to assist law enforcement with fifteen (15) law enforcement related incidents investigated in April 2009. These incidents included: five vandalisms, three thefts, one burglary, three traffic accidents, two domestic disputes and one assault and battery.
A house was egged in the 2800 block of Black Horse Lane. A sliding glass door was damaged with a pellet gun in the 2600 block of Bridal Trail Lane. Numerous construction vehicle windows belonging to Blackburn Construction were shot with a pellet gun in Tract 1990. These investigations are still pending as the suspects have not yet been identified.
Three traffic accidents were reported in April. Two of those were hit-and-run: the first was on Wood Duck Lane where a vehicle collided with a tree. The second was on Bridle Trail Lane where a side mirror was damaged by the hit-and-run vehicle. Red paint transfer was located on the victim’s vehicle. A third accident occurred at the North Gatehouse where a vehicle struck the camera post. In that incident the driver identified herself at the time of the accident and agreed to pay for the damage. The camera post has since been repaired.
A burglary occurred at the 4300 block of Sage Lane on May 13, 2009 between 12:30 p.m. and 2:00 p.m. This crime is still under investigation. Unknown suspects are believed to have entered through an unlocked or damaged door. There were no signs of forced entry. This is a prime example of a day time burglary where the suspects may have seen the victim depart. Many valuable items were stolen, including: a Gateway lap top computer, bottles of assorted wines, jewelry; both Black Hills gold and white/yellow gold with a diamond setting, a Samsung digital camera and a Razor cell phone with a black carrying case. Anyone having any information on the whereabouts of the stolen items is urged to call Security Officer Garner at 805-227-6560 or Sheriff Deputy Calagna at 805-434-4290.
A party turned dangerous resulting in two individuals being arrested on April 25, 2009 for assault and battery; vandalism, under the influence of alcohol and an unknown narcotic substance, and disturbing the peace. Four individuals received injuries in total. This dispute occurred at 4680 Shady Creek Lane which was the scene of a private party. Neither of the individuals arrested were HROA members or tenants. Vandalism of a mail box also occurred in the 3200 block of Waterview which was reported to have been committed by one of the individuals arrested by “smashing it with his head”. The second individual arrested was transported to the hospital by ambulance with “serious head and chest injuries”.
A Jet Ski trailer was stolen from the storage yard on Equestrian Road. There was no license plate attached. Identifying information is a metal tool box attached to the front of the trailer. Theft of gasoline and theft of a mini bike occurred with no further information available as this information was given as a notification only.
Two disputes were reported to have occurred in April. The first one was between neighbors. HROA Security documented the incident which was then handled by the Sheriff’s Department. The second was a domestic battery with the male being arrested and transported to SLO County jail by the Sheriff’s Department.

Tip of the Month – DUI IS A SERIOUS AND DANGEROUS OFFENSE
DUI is one of the few California Vehicle Code violations that Law Enforcement enforces on private property (HROA). With boating season upon us many tend to drink and drive on HROA property. Many accidents occur due to drinking and driving. Use a designed driver and help keep HROA roads safe and accident free.
For those under 21 years of age who by law should not possess alcohol, the DUI law is even stricter. Section 23140 of the Vehicle Code states: “It is unlawful for a person under the age of 21 years who has a 0.05 percent or more by weight, of alcohol in his or her blood to drive a vehicle.” Be cautious as both Law Enforcement and HROA Security strictly enforce the DUI law.
