One (1) complaint regarding a neighbor’s portable shed.

Action: Code Enforcement determined shed was actually a canopy, and was legal per Board policy.  

One (1) complaint related to a stolen weedwacker.   

Action: Investigating Officer took report.

One (1) complaint regarding weekday hours for obtaining new HROA Identification Cards.  

Action: Arrangements made for Owner to obtain ID cards. 

One (1) complaint regarding purported drug activity by neighboring teenagers and associated partying. 

Action:  Assigned to Investigating Officer.

One (1) complaint reporting a vicious dog attack. 

Action: SLO Animal Control contacted, with responsible dog(s) quarantined.  Owner cited.

One (1) complaint regarding a neighbor having overgrown vegetation which was also blocking the complaining party’s view.

Action:  Code Enforcement identified vegetation to be ornamental grass, and that there is no provision for HROA to enforce related to one’s view.

One (1) complaint signed by sixteen (16) separate individuals regarding a request to have “Adult Only” swimming at the Heritage Park Pool

Action: General Manager advised complaining parties that “Adults Only” is restrictive, and may be considered a form of discrimination; and that measures have been put in place to try to allow for better sharing of space (“Adults” and “Non-Adults”).

One (1) complaint regarding a neighbor having a carport which is in the side setback, allowing the roof water to drain directly on the complaining party’s parcel. (Also: No AEC Committee approval)

Action:  Code Enforcement has issued appropriate warnings / citations on this matter.

One (1) complaint regarding a neighbor’s parked vehicle in the cul-de-sac being against the rules, and that the response from the Security Manager was unacceptable (non-responsive and rude).

Action:  General Manager investigated this matter and determined the parked vehicle in question was being monitored, and was legally parked related to the rules; and that other facts related to the personnel complaint was inconclusive.  (Placed in personnel file.)

One (1) complaint regarding the roadway having a depression in it around a sewer lid.

Action:  Code Enforcement documented the incident which appears to be a minor depression, and will be repaired when funds are available.

One (1) complaint regarding several young males at the Equestrian Park engaged in inappropriate behavior including smashing their bikes against the fencing, jumping their bikes on the tables, and using profanity directed at the pool attendant.  The complaint also stated the Security Officer did not arrive at the scene until 45 minutes after being called.

Action:  Security Officer on duty was tied up with the CHP at the time.  Upon arrival, and in follow-up investigation one young male was identified (by the complainer).  The individual was located, met with the pool attendant and apologized and was counseled on the rules.

Summary of action taken at Board Meeting(s) for July 2009

 

In July 2009, the Board of Directors held their regularly scheduled monthly Board Meeting on July 17th.  The following appeals / security related issues were discussed or acted on (by agenda item):

 

2.  Property Owner Appeal – Scruggs, Citation #9171, $25.00 plus $10.00 late fee, No Red Tag  SEQ CHAPTER \h \r 1Citation requested to be voided by Security due to being written in error.
Action: Approved

 

3.  Property Owner Appeal – Rocco, Citation #9355, $500.00, Altering the Common Area (5:15 p.m.)  Action: Upheld

 

4.  Property Owner Appeal – Rodriguez, Citation #9361, $50.00, Unleashed Dog (5:30 p.m.) Action:  Upheld

 

5.  Property Owner Appeal – Alcantar, Citation #9379, $300.00, Illegal Entry (5:45 p.m. or Use Letter) Action:  Changed to a Warning

 

6. Property Owner – Van Pelt, Lot 186 / Tract 475, Common Area Encroachment (Use Letter)  On May 15, 2009 the Board of Directors provided the owner 30 days to move his retaining wall and fence back to the property line.  Van Pelt is a part-time owner and is requesting an additional 60 days to remove the retaining wall and fence.  Action: Board concurred with GM Richey’s over-the-counter approval of a 60-day extension

Summary of Security-Related Activities

 

HROA Security continues to assist law enforcement with a record eighty nine (89) law enforcement related incidents in July 2009, including: thirty disturbing the peace, four house and one vehicle false alarms, two check the welfare, one pipe bomb along with eleven crimes which were investigated, and forty dog related incidents.  

 

The investigated crime incidents included: four vandalisms, two thefts, one burglary, one dog attack, along with one traffic accident, one hit-and-run accident and one DUI arrest.

 

One of the vandalisms occurred at boat slip #40.  Unknown suspects graffitied the boat slip by using an object to scratch numerous sayings and names.   At this point no suspects have been identified.  A separate vandalism occurred at the large pool.  Rocks and glass were thrown in the pool and bottles were broken on the deck.  The clean up was conducted by the HROA Maintenance Department.  At the day beach, a truck with large tires drove through the chain breaking the lock and damaging the pole.  This is still under investigation as evidence was located at the scene.  The entry system was damaged at Tract 1910.  The protective metal barrier and sensor were damaged possibly an entering vehicle.  No one identified themselves as causing this damage. 

 

A victim in Tract 475 reported a theft of gas, motor oil and numerous other items from their vessel and vehicle.  The Sheriff’s Department was notified and the investigation is pending as a possible suspect was named.

 

Two American flags were stolen from the HR Seniors and desecrated.  An investigation was conducted by HROA Security and thanks to members who became involved the suspects were identified and the flags recovered.  The investigation was turned over to the Sheriff’s Department who took the appropriate action.  The suspects are juveniles and for that reason cannot be identified.  HROA Security also issued citations to the individuals involved. 

 

A burglary occurred at 3099 Bridle Trail where a go-cart and other items were stolen.  HROA Security stopped the go-cart on two occasions prior to the burglary being reported and identified and cited the individuals who had possession of the go-cart.  The burglary was reported three days later.  Due to Security’s traffic stop the individuals were identified to the Sheriff’s Department, who took the appropriate action.  These individuals are juveniles and for that reason, cannot be identified.  The suspects were also cited by HROA Security for multiple violations.  The go-cart which was repainted by the suspects, was recovered and returned to the owner. 

 

Two German Shepard dogs in Tract 447 that were chained broke their bonds and attacked a walker and her dog.  The walker was bitten and the small dog was found in the mouth of the other Shepard.  Animal Regulations was contacted and joined the investigation.  The dogs were quarantined.  The walker was treated for her injuries; her small dog had no visible injuries.  The owner of the German Shepards was cited by HROA Security. 

 

A pipe bomb was discovered on the shoreline at the Main Marina near the launch ramp.  The area was secured and the bomb squad was notified.  Approximately three hours later the pipe bomb was discharged.  The pipe bomb appeared to have been in the water for a period of time, with the fuse burnt as if it failed to discharge when lit. This is still under investigation as the makers of these pipe bombs have not yet been identified.    

 

A hit-and-run traffic accident occurred at 2091 Wood Duck Lane. A pick-up truck collided with a pontoon boat which was parked unattended in the street.  The suspect and vehicle left the scene with the driver failing to identify themselves.  HROA Security investigated this incident; they located evidence at the scene and later identified that evidence as belonging to a General Motors product. Security then located the vehicle involved, parked unattended on Buck Tail Lane, and through follow-up investigation, identified the driver.  That information was turned over to the CHP and the owner of the pontoon boat.  The CHP classified this incident as civil and the driver of the Chevy pick-up truck spoke to the owner of the pontoon boat.  No further action was taken. 

 

A DUI driver was arrested after an individual stopped a HROA Security Officer and stated that the driver of the vehicle who just entered HROA through the Main Gatehouse was impaired.  The vehicle was stopped; it was determined the driver was under the influence of alcohol and turned over to the CHP.  HROA Security issued a citation for the violation.

In regard to confidentiality, HROA will make every effort to maintain your confidentiality if you are complaining about another member.  Please keep in mind that certain complaints by their nature might require your cooperation in order to process them to your complete satisfaction. Always be a responsible neighbor and report suspicious behavior, and be an active participant in your neighborhood watch program.

Tip of the Month – There have been numerous pipe bombs located along the HROA shoreline for the past few years.  As we all know this is a very dangerous situation.  As of this date, no one has been injured.  On more than one occasion the pipe bomb was picked up and/or moved by the individual locating the bomb.  Both HROA Security and the Sheriff’s Department have swept the shoreline for pipe bombs.  This does not mean all the pipe bombs have been found.  With the water receding the likelihood of finding another pipe bomb is great.  Some of these devices seem to still be active, so PLEASE do not touch the bomb and notify SECURITY immediately.   Educate your children to follow those simple rules.  A picture of the pipe bomb has been posted in the bulletin board at the HROA Office.  Stop by and show your children the photograph.
